The Professional Standards Council of Victoria was established under section 42 of the Professional Standards Act 2003 (Vic).

The Professional Standards Council of Victoria was constituted on 2005 with 12 members nominated by each state and territory Attorney General, as well as one nominee by the Commonwealth Assistant Treasurer.
